NYS OMH announces the availability of capital funds for the preservation, restructuring and/or expansion of OMH Article 31 Licensed Residential Treatment Facilities (RTFs) and Mental Health Clinics licensed to serve children throughout NYS. Successful Applicants will demonstrate in their proposal a direct relationship between the proposed capital project and an improvement in the program's viability, accessibility, the quality of service delivery/environment and/or the capacity to meet their population needs.
Priority (as defined in Section 4.3.1 of this RFP) will be given to RTFs and OMH designated Vital Access Providers (VAP) outpatient mental health clinic awardees serving children.
This RFP is intended to address the capital needs to better meet the emerging needs of the children's behavioral health system in one or more of the following areas: Preservation, Restructuring, Expansion.

All proposals to this RFP must be submitted through the Grants Gateway portal. No hard copy or electronic (email) submissions will be accepted. Instructions for this can be found in Section 2.9 of the RFP.

AUGUST 14th UPDATE - OMH is clarifying that county run OMH article 31 freestanding clinics (who received VAP funding) are eligible and will allow for the submission of proposals to the “Capital Grants for Preservation, Expansion and/or Restructuring of Children’s Clinics and RTFs” RFP. As such, the due date for the proposals from all applicants will be extended until October 10, 2018 with tentative award notification of November 14, 2018. The New York State Office of Mental Health (OMH) has determined that a technical fix is required to address confusion regarding the eligibility criteria for applicants responding to the “Capital Grants for Preservation, Expansion and/or Restructuring of Children’s Clinics and RTFs” Request for Proposals (RFP). Thus, further clarification is being issued to ensure all potential applicants have a thorough understanding of the eligibility requirements.
Further, in the interest of making awards to as many qualified applicants as possible, OMH is amending the minimum average score in Section 4.2 Method for Evaluating Proposals and will now be considering all applications with a minimum average score of 65.
Accordingly, OMH will be re-opening the RFP on Tuesday, December 18, and extending the deadline for applications (see revised timeline below). Please refer to the OMH website for details on applying through the Grants Gateway. Those who have already submitted applications in the Grants Gateway will have the opportunity to re-open their applications, should they wish to do so. It is not mandatory and no recommendation will be made by OMH to proceed one way or the other. Please note that should the decision be made to re-open the application, it the responsibility of the applicant agency to ensure that it be submitted by the due date and time of February 8, 2019 at 4:00 PM. No consideration will be given to an applicant that misses this deadline. If you would like to have your application re-opened and accessible for additional work, please make the request to the Issuing Officer, Carol Swiderski, in writing to carol.swiderski@omh.ny.gov.
Eligibility Clarification
With respect to Section 2.5 Eligible Agencies, please note the following amended language in paragraphs 1-3:
“Eligible Applicants must operate OMH Article 31 Residential Treatment Facilities (RTF)s or free-standing clinic treatment programs with an OMH Operating Certificate, at the time of submission of the RFP application, that states “children” and/or “adolescents” next to “Population Served.” Hospitals licensed pursuant to Article 28 of Public Health Law and Federally Qualified Health Centers are not eligible to apply. This grant is specifically targeted to Article 31:
A) Free-standing Clinics licensed to serve children B) Residential Treatment Facilities (RTFs)
Programs with operating profits in excess of ten percent for each of the three most recent fiscal years (Downstate: 2014-2015, 2015-2016 and 2016-2017; Upstate: 2014, 2015, 2016), as reported in the Consolidated Fiscal Reports (CFR), are not eligible to apply. For clarification purposes, ‘Programs’ is defined as Article 31 free-standing clinic and RTF programs.”

Several inquiries have been made as to the specific reasons for the extensions and re-opening of the “Capital Grants for Preservation, Expansion, and/or Restructuring of Children’s Clinics and RTFs” RFP. To provide additional clarification for all current and prospective applicants, OMH offers the following:
- OMH’s intent was for all child serving Article 31 licensed clinics designated as Vital Access Provider (VAP) programs to be eligible to compete for this Request for Proposal (RFP). The VAP programs were designated under Part 530 of 14 New York Codes, Rules and Regulations to stabilize and preserve access needed clinic services throughout all geographic regions of the state. - - In the original RFP, the eligibility language in Section 2.5 inadvertently excluded county operated clinics. As such, OMH exercised its right to make clarification and extend the due date so that these county clinics including designated VAP providers would have an opportunity to apply.
- As part of the Question and Answer (Q&A) process, numerous questions were posed seeking clarification on whether certain licensed agencies and/or programs would be eligible to apply. OMH later realized that the Q&A responses with the revised issuance inadvertently excluded nonhospital based freestanding providers that also had a separate Article 28 license for their diagnostic and treatment centers. As such, OMH exercised its right to extend the date of award to provide all eligible entities including designated VAP providers with an opportunity to apply.
- To ensure maximum participation and awards, OMH is revising the passing score from 70 to 65. OMH is making this change to ensure that all the funds available will be fully allocated and awarded to applicants. Furthermore, if the selected projects are subsequently withdrawn by the applicant, the RFP will allow for the award to other viable projects with the highest passing scores.
OMH is taking these steps to preserve and ensure open and fair competition, and at the same time, fulfill its mission and meet agency needs to award these funds to support capital projects for the children’s system.
